An employer’s obligation to disclose the formal working conditions to an employee when forming an employment contract is stated in section 1 of Article 15 of the Labour Standards Law. This applies regardless of the worker’s nationality. A foreign national worker should confirm that the following are clearly stated in their employment contract.
- The duration of the employment.
- Conditions and standards regarding the renewal of the employment contract when the current contract expires.
- The place(s) of work and the nature of the work.
- The time when the work starts and finishes each day; if there is fixed time for the work; break times; day(s) of rest in a week; annual leave entitlements; details about the roster if the work is based on a roster system.
- The wage (not including retirement benefits and extraordinary payments),;the payment method and the method for wage calculation; the usual payment time; any deadlines relating to wage payments and about the conditions for future pay rises.
- Termination conditions including redundancy, discharge, and the age of retirement.
