8 Working conditions in the employment contract

An employer’s obligation to disclose the formal working conditions to an employee when forming an employment contract is stated in section 1 of Article 15 of the Labour Standards Law. This applies regardless of the worker’s nationality. A foreign national worker should confirm that the following are clearly stated in their employment contract.

  1. The duration of the employment.
  2. Conditions and standards regarding the renewal of the employment contract when the current contract expires.
  3. The place(s) of work and the nature of the work.
  4. The time when the work starts and finishes each day; if there is fixed time for the work; break times; day(s) of rest in a week; annual leave entitlements; details about the roster if the work is based on a roster system.
  5. The wage (not including retirement benefits and extraordinary payments),;the payment method and the method for wage calculation; the usual payment time; any deadlines relating to wage payments and about the conditions for future pay rises.
  6. Termination conditions including redundancy, discharge, and the age of retirement.
